Divorced women missing out on pension assets

Women are failing to claim a fair cut of their former husband’s pension in divorce settlements, reports Elizabeth Anderson. Only three in ten couples discuss pensions when they split up, according to research by Scottish Widows. John Oxley, a barrister at Vardags, says: “The starting point in English law is that assets built up during the marriage should be split on a 50-50 basis, and this includes any pension benefits accrued in that period. Pension sharing orders are routinely made by the courts and, for UK pensions, are easily implemented.”
